Informing and Consulting - April 2008

Smaller organisations now fall within the scope of the Information and Consultation of Employees Regulations 2004 (‘ICE Regulations’) affords employees the right to be informed and consulted on a regular basis about issues at work. From 6 April 2008 undertakings with at least 50 employees in the UK enjoy this right. The duty to inform and consult is not automatic; rather it has to be initiated either by employees or employers. In the case of employees, at least 10% of the workforce must have requested that the employer negotiate an agreement in respect of informing and consulting. In the case of employers, they may initiate negotiations under the regulations by giving notice in writing.
