Sarah is a litigator in the Commercial Litigation Department and deals with commercial and insolvency issues for individuals, businesses, Trustees in Bankruptcy and Liquidators.

Sarah's experience includes:

  • Advising on high value contractual disputes and sham trust disputes
  • Obtaining injunctions to protect her client's assets
  • Enforcing judgments
  • Issuing claims on behalf of Trustees in Bankruptcy and Liquidators against Directors and others for misfeasance, preference, transfer at an undervalue claims and more
  • Realising bankruptcy and liquidation assets on behalf of insolvency practitioners including assets based outside of the jurisdiction
  • Advising Shareholders that are in dispute
  • Advising on and issuing unfair prejudice, derivative and other claims brought by shareholders

Sarah also advises on all employment law related issues, including but not limited to:

Employer perspective

  • Drafting employment contracts and company policies
  • Advising in relation to disciplinary and grievance procedures
  • Advising in relation to the redundancy process
  • Drafting settlement agreements

Employee perspective

  • Reviewing matters and providing advice as to whether the employee has any potential claims against the employer
  • Calculating the amount of damages which may be available
  • Issuing claims in the employment tribunal proceedings including sexual harassment, discrimination, unfair dismissal, equal pay and breach of contract
  • Advising on settlement agreements and the effect of post termination restrictions
  • Negotiating the terms of settlement agreements

Sarah has experience in both high value and complex litigation cases which have proceeded to trial as well as less formal resolutions of disputes such as mediation.

Sarah enjoys the daily challenges her role brings and feels a great sense of satisfaction being able to help clients obtain successful resolutions.

Recent cases Sarah has worked on

Sarah recently acted on behalf of a liquidator who was informed that a bankrupt based in the UK (for whom he was trustee) who had not disclosed a Spanish asset during his bankruptcy and as a result, had therefore deprived the creditors of a payment. She was able to locate the Spanish asset, assess the bankrupt's interest in it and successfully obtained an urgent worldwide freezing order injunction against the bankrupt in order to prevent the sale of the asset. The matter concluded successfully with a payment being made to creditors.

Sarah recently acted on behalf of a liquidator in bringing a claim against a shadow director for the recovery of a directors' loan account and other transactions that were intended to defraud creditors. The matter concluded successfully through mediation with a payment being made to creditors. 

Sarah has recently acted for a client who, upon her return from six months’ maternity leave, was refused access her original role. Sarah successfully secured a settlement agreement which entitled the client to compensation in excess of £100,000. Sarah also managed to agree with the client’s employer that she would no longer be bound by any of the restrictive covenants imposed upon her. 

Sarah assisted in a claim in which she acted on behalf of 10 individuals (who were mostly based in South Africa), as well as an agent, against a property development company. The property development company commenced a project to construct and develop a luxury hotel in Yorkshire. The company hired an agent to locate individuals who purchased various leases for the individual rooms within the hotel. The development company failed to build the hotel and retained all investment monies. Sarah was instructed to pursue the development company for non-payment of the agent’s fees and to recover the monies which had been invested by the 10 individuals. Sarah worked alongside another law firm based in Johannesburg in order to take instructions from the clients. Sarah attended court on numerous occasions to go before various Masters in order to obtain urgent injunctions, a writ of control and possession and judgment.  

Sarah acts for various insolvency practitioners in pursuing claims against directors for misfeasance and unpaid director’s loan accounts. 

Sarah has recently acted on behalf of a defendant in a boundary dispute which includes issues in relation to trespass, nuisance and a party wall. Sarah made several successful applications with costs being awarded in her client’s favour. 

Sarah is currently representing two claimants in a complicated trust dispute in which they have intervened in separate family proceedings to secure their interests. 

Sarah is acting on behalf a company pursuing payment of unpaid and disputed invoices over a six month period. She has managed to secure a judgment against them and is now recovering the debt through the insolvency procedure. 

Sarah acts on behalf of both individuals and companies enforcing judgments by way of High Court Enforcement Officers, Orders for Sale, Attachment of Earnings Orders and Insolvency proceedings. 

Sarah has recently drafted employment contracts for a well-known and highly prestigious international interior design company. The contracts required specific attention to detail in relation to restrictive covenants.

Sarah has run multiple cases in the Employment Tribunal which include claims for unfair dismissal, constructive dismissal, whistle-blowing and discrimination; acting on behalf of both the Claimant and the Respondent.

Outside of work, Sarah enjoys spending time with family and friends, travelling, keeping fit and sporting activities. She has bungee jumped, sky dived and most recently ran the Royal Parks Half Marathon for charity.
